  • What the collection agencies cannot do?


    Debt collectors hired by the creditors have the responsibility to collect the debts from the debtors. The more the debts they collect, the more they are paid. The creditors approach the collection agencies to collect debts on their behalf because the lenders cannot deal with debtors who miss several payments. Even though you are in a bad financial condition, you cannot expect fair relationship with the creditors if you don’t bother to inform them. The collection agencies are very strict and sometimes, they use unethical practices to collect debts from those who cheat. While it is your responsibility to pay all your debts, the agencies cannot humiliate you. They have to follow the fair debt collection practices act (FDCPA) to collect debts from you.

    The debt collection agencies cannot call the debtors before 8 am and after 9 pm. Some states allow the debt collectors to call you at work, but this is prohibited in many states. It is important to know your state policies before you accuse the agent. Harassment on phone is not allowed for the debt collectors. Some agencies tend to harass those debtors that don’t care to repay the debts. Though it is the responsibility to collect the debts, the agencies cannot involve in such illegal practices.

    Several innocent debtors are frightened by the agencies when the agents call themselves as officials from the government credit bureau. This is illegal and the collection agencies cannot give false identification. When you have someone calling themselves as government officials, you have to check their identity before you speak to them. The agencies cannot send unlawful people to your home to threaten to physically or mentally. Abusive strategies to collect the debts are not allowed for the collection agencies irrespective of the amount of debt. Moreover, the agents should never hide their identities.

    The debt collection agencies cannot give wrong information about the amount of your debts. They are not entitled to collect more than the money you actually owe. Providing false information that they have filed a case against you when they actually didn’t is not allowed. If they use statements such as you are guilty of a crime and you have to be arrested, then understand that they are following illegal practices. However, the agency has to inform you that they are going to take legal action.

    If you are harassed or humiliated by any collection agency, you can send a cease and desist letter to the agency, stating that you don’t want them to contact you. You have to send a letter with return receipt so that you can be sure that the letter reached the agency. After receiving the letter, the agency cannot contact you any more. However, you are entitled to pay your debts and the creditor may appoint another collation agency to collect the debts from you. You have to know the rights to be aware of agencies that use immoral ways to collect the debts. At the same time, you have to try to cooperate with the agent and request fair treatment, stating that you are interested in repaying the debts, as it is your moral responsibility.
